Business negotiations - One myth and eight tips from the real world.

The myth

Most training courses in negotiation will advise you that the “win/win” result is always what you should aim for. That's when both parties feel they have done well out of the deal, and both want the other to do well, too. It's a myth because only if both parties want it, is it possible to achieve a result that satisfies them both.
Tip one- watch out for “animals”

All too often, in my experience, the other side's version of “win/win” is that they win twice! So my first tip in this article is to try and work out what kind of negotiator you are facing. If they are genuinely seeking a mutually satisfactory result, then work towards one. But if they are the kind of negotiator that only feels satisfied if they have “won” and you've been destroyed, then defend yourself and fight for your life! And if you are facing one of the “animals” of the business world, and you need the negotiations to result in a long term partnership of some kind, you've got a problem. It may well be best to walk away before the negotiations start, because the two parties will never be happy together!

Tip 2- think about the power balance

As part of your preparations you need to think about where the power lies. If you are “buying”, how eager will the other side be to make a sale? Do you have alternative possible suppliers who might be more eager? If you are “selling”, try and work out whether you have genuine competition for the deal, or whether you have some competitive advantage that will push the prospective customer towards you. Your analysis won't be perfect, but this sort of thinking will help you evaluate the negotiating process as you go through it.

Tip 3- get the legal advice early

If you are about to negotiate a contract that will, in the end, have to be vetted by a lawyer before being signed, you will find that it's best to get legal guidance before the negotiations, rather than after. You will present yourself as much more authoritative if you know ahead of time what the lawyer will expect to see in the agreement you negotiate, and this will add to your power in the actual negotiating process.

Tip 4- define your objectives, and your absolute minimum result, in advance

Before you start negotiating, you should always be clear in your own mind what a satisfactory result would be. You need to be clear on your minimum; below this level you don't do business. Check out with your co-decision-makers, and your boss if the deal is a big one, where they think the line should be drawn. Stick to it; keep it at the forefront of your thinking during the negotiations, but never on any account let the opposition know where your limit is, because that would inevitably become their maximum!
Tip 5- take your time

You don't need to rush. If you ever start to feel that the other side is rushing, maybe pushing deadlines at you, then be very careful in case this is a tactic to “bounce” you into a deal that you might live to regret! If you need time to think, or make calculations, or consult others, then take it. Call a “time-out”, go off into another room, and do what you need to do, in your own time. It's particularly important if there are several of you  in a negotiating team to take regular breaks, so that you can consult and agree future tactics.

Tip 6- keep the whole deal in view

Try to remember all the possible elements of the deal, and make sure that both parties agree them all. It's humiliating, and sometimes catastrophic, if you agree a deal but find you have to re-start the negotiations because some element of the deal got lost along the way. If you are a seller, keep summarising the negotiation, mentioning all the elements of the proposal you are trying to sell. If you are a buyer, try to get as much as possible free, included without extra charge in  the overall deal.
Tip 7- keep notes

When something is agreed, write it down. After the meeting write to the other party to confirm the agreements made. Remember the old saying; “If it's not written down, it didn't happen.”

Tip 8- take care with language

And finally,when you are re-reading a contract just before signing it, remember that words matter, especially in contracts where lawyers are involved. Many legal words have unusual or unexpected meanings. Reading a lawyer's contract can seem  quite like reading a foreign language.
If your contract is written in English, as so many international agreements are, and English is not your mother tongue, you need to be especially careful. English is a really flexible language, and is capable of both great precision and great vagueness!

Cash control is the first essential. Businesses fail on the upswing out of recession, as well as during the recession itself. Mostly they have kept going during the downturn by a mix of borrowing, getting credit from their suppliers and keeping wages down. Then the climate for business improves; suppliers want to cut their creditors back to normal, staff want to see some reward for loyalty, and banks find big new exciting ways of investing their money, and want their older loans repaid.

Business English Training: keys to success

We all know why modern business in the non English-speaking world needs the international language. The market for staff business English training in many countries, especially those Asia and South America, is growing at a blistering rate, fueled by the rise of globalization and a realization among managers that a certain level of competency in their staff's English is a must, if their business is going to compete. Of course where the market appears, so do the companies set up to capitalise. Deciding on a language training provider can be daunting, and the unregulated nature of the training industry in most countries can mean huge variation in the quality of the training, and therefore huge variation in the return on investment for the companies' management. So, what is it that makes some training effective, while other programmes are a waste of time? How can companies minimize the risk of investing in lame-duck language training?

The first piece of advice is to make informed decisions on language training providers based on information from reliable sources. Websites, brochures, marketing emails and fliers can hold a great deal of information, but the reliable most reliable source is a person who has attended or been involved in training elsewhere. One must be careful though, as the â018famousâ019 providers - those with strong brand recognition - may be well-known as a result of an over-emphasis on marketing, and not necessarily on quality. 'Big' is not always 'better' when it comes to training providers; larger establishments usually struggle to find enough good teachers, and compromises are sometimes made. Moreover, while smaller schools tend to be run or heavily influenced by the most important people, the teachers, larger training centres inevitably move towards being driven solely by the bottom line. This is not to say that one should shy away from providers with strong marketing; we're looking for providers who like to show off their benefits, after all. Be wary of those who aren't willing to talk about their benefits.

Sebuah website, laporan, atau proposal bisnis bisa saja berisi informasi yang lengkap, argument yang kuat, dan rancangan yang mampu memberikan inspirasi. Tapi kesemuanya akan gagal total dalam mencapai tujuan dasarnya apabila bahasa yang dipergunakan mengandung kesalahan. Ini karena kita secara otomatis menilai lebih rendah sebuah hasil kerja yang dituangkan ke dalam sebuah tulisan yang buruk, sekalipun kesalahan yang ada hanya dari segi bahasa. Sebuah tulisan yang buruk membuat kita mempertanyakan kualitas dari produk, customer service atau fitur-fitur penting lain dari perusahaan dalam tulisan tersebut.Nah, bahasa manakah yang anda yakin mampu anda gunakan untuk menulis dengan baik? Jarang ada orang di dunia ini yang memiliki kepercayaan diri penuh dalam menggunakan bahasa lain selain dari bahasa asli mereka. Sebagian besar dari kita bahkan bisa saja menemukan kesulitan dalam menggunakan bahasa asli kita dari waktu ke waktu. Dan penulis yang terbaik cenderung merupakan orang-orang yang mampu mengenali kesalahan-kesalahan kecil yang mereka buat, dan secara otomatis mendeteksi dan mengkoreksi kesalahan tersebut.Barangkali hanya ada kurang dari satu di antara sejuta penduduk dunia yang mampu menulis dengan tanpa cela dalam bahasa selain dari bahasa ibu mereka. Dan menulis dalam bahasa Inggris, bahasa internasional de facto, adalah hal yang sulit. Terutama apabila anda tidak dibesarkan dengan bahasa tersebut, tidak mengenyam pendidikan tingkat tinggi di bidang tersebut, dan belum pernah membaca ratusan buku dan ribuan surat kabar yang ditulis dalam bahasa Inggris.Ada banyak sekali kemungkinan kesalahan. Kosakata dan struktur, sudah pasti. Ada juga tanda baca yang merupakan masalah bagi banyak penutur asli bahasa Inggris. Lalu ada pula jebakan berupa "register", yang menurut kamus saya berarti "bentuk bahasa yang diasosiasikan dengan situasi sosial atau pokok bahasan tertentu". Apapun yang anda tulis, makalah teknik atau brosur penjualan, apabila register yang anda gunakan salah, hasil kerja anda akan sia-sia.Berikut ini adalah tiga aturan utama. Pertama, jangan menganggap bahwa apabila seseorang mampu berbicara dalam bahasa Inggris dengan baik maka ia otomatis mampu menulis dengan baik pula dalam bahasa Inggris. Kedua, tulislah dengan persis apa yang ingin anda katakan, dalam bahasa asli anda.  Ketiga, carilah penyedia jasa dua bahasa untuk menuliskan pesan anda tadi dalam bahasa Inggris. Harap dicatat bahwa saya tidak menggunakan kata "penerjemahan" di sini. Pesan akhir yang muncul di website atau brosur anda hampir dapat dipastikan bukan merupakan terjemahan langsung dari aslinya. Pesan akhir ini akan merupakan sebuah tulisan kreatif baru. Tulisan asli anda akan diterjemahkan ke dalam sebuah draft berbahasa Inggris, dan selanjutnya digunakan sebagai referensi untuk membuat teks baru dalam bahasa Inggris.Sebagai penutup, pikirkanlah hal berikut mengenai Internet. Internet lebih informal dibandingkan dunia cetak. Jadi anda tidak bisa sekedar memasang brosur anda di web; yang berarti anda harus membuat sesuatu yang baru. Caranya mudah dan cepat. Tetapi kesalahan apapun yang mungkin terjadi dalam prosesnya dapat berpengaruh pada ribuan pelanggan potensial. Artinya, sangat penting bagi anda untuk memastikan bahwa apapun yang anda publikasikan di Internet adalah akurat. Lost in Translation.

Websites, reports, business proposals - all can be full of good information, clear argument and inspiring design. And all can fail totally in their basic purpose if their language is faulty in some way. That's because we automatically devalue the work that went into a badly written piece, even if it's only the language that is at fault. A badly written piece makes us uneasy about product quality, customer service or a host of other important features of the company concerned.

Now- which language can you be most confident of writing well? Scarcely anyone in the world can be totally confident in any but their mother tongue. Indeed many of us find that even the language of our childhood can present challenges from time to time. And the best writers tend to be those who recognise the subtle mistakes they are capable of making, and automatically proof-check for them.

Probably fewer than one in a million of the world's population can write flawlessly in a language other than their mother tongue. And writing English, the de facto international language, is difficult. Especially if you were not brought up speaking it, and were not educated to a high level in it, and have not read hundreds of books and thousands of newspapers written in English.

Pitfalls are legion. Vocabulary and grammar, of course. Also punctuation, which is a real problem for many native English speakers. And then there is the minefield of "register". My dictionary defines this as " a form of a language associated with a particular social situation or subject matter". Whether you are writing a technical paper or a sales brochure, if you get the register wrong your work is wasted.

So here are three golden rules. First, don't assume that if you speak English well you can write it equally well. Secondly, write exactly what you want to say, in your native language. Thirdly, get a bilingual service to write your message in English. Please note that I'm not using the word "translation" here. The final message that appears on your website or in your brochure will almost certainly not be a direct translation of your original. It will be a new piece of creative writing. Your original will be translated into an English draft, and this will be used as a reference for a new English text

To close, here's a thought about the Internet. It's less formal than the world of print. So you can't just put your brochure on the web; you do have to produce something new. It's quick and easy to do this. But any mistake may potentially influence thousands of potential customers. So it's even more important to make sure that whatever you publish on the Internet is correct.
